Sybase IAD Services Contest
Official Rules

1.  ELIGIBILITY:
The Sybase IAD Services Survey Contest (“Contest”) is a promotion open only to US residents.  The contest opens on August 26, 2004 and closes on October 1, 2004 (“Entry Period”).

Please Note:  It is your sole responsibility to review and understand your employer’s policies regarding your eligibility to participate in trade promotions such as this Contest.  If you are participating in violation of your employer’s policies, you may be disqualified from entering this sweepstakes or receiving prizes.  Sybase IAD Services disclaims any and all liability or responsibility for disputes arising between an employee and their employer related to this matter, and prizes will only be awarded in compliance with the employer’s policies. 

2.   HOW TO ENTER:
There is no purchase necessary to enter or win.

A. The individual completing the survey will automatically be entered into the sweepstakes drawing for a Logitech® IO™ Pen.   Entries will be tracked by Sybase IAD Services through completed surveys.  Limit one entry per person.

Limit one entry per person per day, irregardless of entry method.  Subsequent entries from the same individual on a single day will be automatically disqualified. No responsibility is assumed by Sybase® IAD Services and their affiliates for lost, late, and/or misdirected entries or any computer, online telephone, or technical malfunctions that may occur. All entries become the property of Sybase IAD Services and will not be shared with any third party.

3. WINNER SELECTION / PRIZES:
On or around September 15, 2004, 1 winner will be chosen in a random drawing from among all eligible entries received to win one prize. Random drawing will be conducted under the supervision of Sybase, whose decisions are final. Odds of winning depend on the number of eligible entries received.

No substitution or transfer of prize permitted, except by the sponsor who reserves the right to award a prize of equal or greater value if advertised prize is unavailable.  All taxes on prizes are the sole responsibility of the prizewinners.  The decision of the judges is final and binding in all matters related to this contest.  All prizes will be awarded provided a qualified number of entries are received.  Winners will be notified by e-mail and/or by regular mail within 7 days of winner selection.

4.   GENERAL CONDITIONS:
Entrants agree to abide by the terms of these Official Rules and by the decisions of the judges which are final on all matters pertaining to this contest.  All federal, state, local, provincial and municipal laws and regulations apply.  This contest is subject to the laws of the United States.  Prize winner may be required to execute and return an Affidavit of Eligibility/Liability and Publicity Release.  If required, these documents must be submitted within seven (7) days following attempted notification.  Failure to comply within this time period may result in disqualification and selection of an alternate winner.  Return of any prize/prize notification as undeliverable may result in disqualification and selection of an alternate winner. Entrants further grant to Sybase IAD Services the right to use and publish their proper name, state and submission online and in print in any other media in connection with the Contest.  Acceptance of a prize constitutes permission for Sponsor to use winners' names, likenesses, pictures and submitted creations for advertising and promotional purposes without additional compensation unless prohibited by law.  By entering,  participants release and hold harmless Sybase, its affiliates, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability or any injuries, loss or damage of any kind arising from or in connection with this contest or any prize won.

5.  INTERNET:
If for any reason the Internet portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sybase IAD Services which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Sybase IAD Services reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Contest. Sponsor assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sybase IAD Services on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Contest.  CAUTION:  ANY ATTEMPT BY A CONTESTANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.  In the event of a dispute, entries made by Internet will be declared made by the authorized account holder of the e-mail address submitted at time of entry.  "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, online service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail address for the domain associated with the submitted e-mail address.  In the event of any dispute, potential winner must provide sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry.
